Council approves tough sanctions for smokers


Surabaya will impose stern sanctions on people caught smoking in public places in an effort to protect its people from the dangers of cigarettes, with the introduction of a new anti-smoking legislation. The new bylaw was confirmed by the municipal legislative council and it will take effect in Oct. 2009, with three months’ imprisonment and/or maximum fines of Rp 50 million for anyone caught smoking in public areas.

Under the regulation, public spaces are defined as any public areas, but authorities will most probably focus on bus terminals, ports, public transportation vehicles, railway stations, hospitals, government buildings, hotels and campuses.

Chairperson of the municipal legislature special committee which prepared the bill, Retna Wangsa Bawana said: “We (the council) have asked the mayor to prepare all required tools to educate the public about the new bylaw over the next 24 months so the city will be prepared with law enforcers. Besides endangering public health, smoking was a disturbance, especially in workplaces.”

Recently Malang municipal administration set up smoking places in public areas including government buildings, using taxes and excise from cigarette manufacturers. The mayor of Malang said: “With the possibility of weak law enforcement to begin with, we will encourage the city administration to enforce the bylaw continually.”

Vice mayor Arif Affandi said: “I would stop smoking personally and that the city authorities would deploy a special task force from the civilian police to enforce the new laws. The city had received Rp 2 billion from government revenue that came from cigarette excise.

Smokers said they would make no objections to the legislation, as long as smoking areas could be found easily. Ahmadi said, while smoking in his car: “I have found no smoking areas at the airport, shopping centers or government buildings in the city. Non-smokers have the right to a smoke-free environment but smokers also have the right to smoke. All public figures, including councilors and government officials should set a good example by not smoking. The government must also punish violators indiscriminately. The anti-smoking bylaws will not be effective unless cigarette factories are closed down, and imports of foreign cigarettes are halted. Shutting down the cigarette industry will be a nightmare for millions of workers and their families in the province.”
